Terms and Conditions

Please note that the Terms and Conditions which are published on our website supersede those in any booking confirmation or elsewhere.

The following Terms and Conditions form the basis of your binding contract with Island RIB Voyages (Jersey) Limited. This binding contract comes into existence when we dispatch our booking confirmation email to you (the person who makes the booking). Please read them carefully as they set out the respective rights, obligations and responsibilities for both parties.

Definitions
In these Booking Conditions, “you” and “your” means the lead name on the booking (including anyone who is added or substituted at a later date). “We”, “us” and “our” means Island RIB Voyages (Jersey) Limited.
"Schedule Trip" means a trip that is advertised on our website and for which we have a published departure date and time and can be booked on our website.
"Private Charter" means a trip that is not advertised on our website and for which we have booked a departure date and time with you or for you, and which is not available for booking by the general public and for which you have paid for the entirety of the vessel.

Right to change Terms and Conditions
We reserve the right to change these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website. We also reserve the right to vary these Terms and Conditions for any particular booking at any time, if we find it reasonable to do so. We further reserve the right to vary these Terms and Conditions, if we find it reasonable to do so.

General
Once you (the lead name on the booking) have received a booking confirmation from us, you agree to take full responsibility on sharing the following Conditions to the group who will be taking part in the trip, ensuring that all persons are aware of the following:

  • Accessibility
    If you require accessibility accommodations, please notify us during the booking process. Where possible, we will provide assistance with boarding and seating arrangements to meet your needs. Please note that physical capability requirements still apply for safety purposes.

  • Physical capabilities
    You must be physically fit enough to board our vessels by stepping up or down 60cm. In some circumstances, whilst operating offshore and when slipways or piers are not accessible, there will be a small ladder used. If you are not confident using a small ladder, you are entitled to stay onboard until you return to Jersey. You must be able to sit unaided in an upright position, have full control of your head and upper body and be able to grip any rails or handholds securely; you must also be able to brace yourself with your legs and feet.

  • Physical assistance
    If you have a disability which requires physical assistance, you must be accompanied by at least one helper who is aged 18 or over, who must be able to provide you with any requisite assistance in the event of emergency or evacuation procedure.

  • Health
    All boats can experience unpredictable movements that could aggravate existing medical conditions. You must be in good general health and confident that the activity is within your abilities. You must make us aware, in writing by email, during the booking process, or any time before the start of your trip, of any injuries, illnesses and/or medical conditions that are likely to affect your health and/or safety during the trip. We cannot take you onboard if you are suffering with back, neck or heart complaints.

  • Pregnancy
    Without exception, we cannot take you onboard if you are pregnant.

  • Acceptance of Risk
    The decision to undertake our trips and the consequences of doing so are entirely at your own risk. We do not accept any liability for personal injury, or injury to others and/or loss or damage (except through gross negligence).

  • Injury or incidents
    You must immediately declare to a skipper any incident or injury that arises whilst onboard our vessels. We will then, at the earliest convenience, fill out and log an incident report form, which will be sent to you via email. Failure to immediately declare an incident or injury to a skipper negates any liability in respect of future claims against us as these cannot be substantiated. To mitigate risks, we have conducted a full risk assessment for our operation. We also have a Safety Management System to ensure we provide you with the level of care and safety appropriate for the activity. Extracts of these documents are available on request.

Making your booking
The person making the booking (“the party leader”) must be at least 18 years old and must be authorised to make the booking on the basis of these Terms and Conditions by all persons on the booking. By making the booking, the party leader confirms that he/she is so authorised and that all party members agree to be bound by these Terms and Conditions. The party leader is responsible for making all payments due to us. Once we have received your request for a booking, we will, subject to availability, confirm your trip by issuing an email confirmation. This confirmation will be sent to the party leader or your travel agent. Please check this confirmation carefully as soon as you receive it. Contact us immediately if any information which appears on the confirmation or any other document appears to be incorrect or incomplete as it may not be possible to make changes later. We regret we cannot accept any liability if we are not notified of any inaccuracies in any document sent out.

Booking Confirmation and Payment
Your chosen trip is confirmed by the act of emailing of a booking confirmation, sending of an invoice by post or email, or both or either. The booking is deemed as confirmed when the email leaves our mail servers, non-delivery, and delivery to spam or any other means that prevents the delivery of the booking confirmation or invoice to the destination mailbox does not preclude the customer from being liable for the booking. We may request full or part payment to guarantee the booking. We require full payment within two days prior to the trip departure date. Cancellation fees may apply for any confirmed booking that is cancelled.

Your contract
Subject to the clause "Making Your Booking", a binding contract between us comes into existence when we despatch our confirmation email to the party leader or your travel agent. We both agree that Jersey Law (and no other) will apply to your contract and to any dispute, claim or other matter of any description which arises between us (except as set out below). We both also agree that any dispute, claim or other matter of any description (and whether or not involving any personal injury) which arises between us must be dealt with by the Courts of Jersey only.

The cost of your trip
We reserve the right to increase or decrease the prices of unsold trips at any time. The price of your chosen trip will be confirmed at the time of booking. The prices published on our website supersede those elsewhere.

We reserve the right to correct errors in both advertised and confirmed prices. We will do so as soon as we become aware of the error. Please note, changes and errors occasionally occur. You must check the price of your chosen trip at the time of booking.

Insurance
We are fully insured while you are aboard the boat only. In the event that you go ashore during one of our trips, you are no longer covered by us.

We therefore consider adequate and appropriate travel insurance to be a recommendation to the booking. If you do not have travel insurance, we will not be held responsible for any loss, damage or personal injury whilst you are ashore.

Alcohol and Drugs
Any illegal substances will not be tolerated onboard. Any passengers suspected of being under the influence of an illegal substance will be reported to the police and will not be permitted to board the boat.

Excessive drunkenness will not be permitted on board. Any passenger who is incapable of looking after themselves or presents a danger to the boat or other passengers due to high levels of intoxication will not be allowed to board, and this includes for a return journey. In such an instance, it will be the responsibility of the passenger to find accommodation and/or alternative travel back to Jersey at their own cost. The skipper retains the right to make the decision if they deem a passenger too drunk to board. If a passenger is refused to board due to drunkenness, a refund will not be provided. The incident will also be reported to the coastguard.

Smoking
Smoking, including e-cigarettes is strictly prohibited aboard our boats.

Violence
Violence or aggression will not be tolerated. Any passenger who displays violence or aggression will not be allowed on board and will be reported to the Police. A refund will not be provided.

Scheduled Trips - Changes by you
Should you wish to make any changes to your confirmed trip; you must notify us in writing by email as soon as possible. Whilst we will endeavour to assist, we cannot guarantee we will be able to meet any such requests.

In the event that the change is to a trip of a different price, the price difference will be payable by you or refunded to you as appropriate less a 5% administration charge to cover bank and/or credit card charges.

Scheduled Trips - Cancellation by you
Should you or any member of your party need to cancel your chosen trip once it has been confirmed, the party leader must immediately advise us in writing by email. Your notice of cancellation will only be effective once it is received and confirmed by us.

As we incur costs from the time we confirm your booking, the following cancellation charges will apply.

  • Cancellation more than 7 Days before the trip - You will be offered either, a full refund for any payments already made less a 5% administration charge to cover bank and/or credit card charges, or a full credit for any payments already made will be credited to your client account to be used on any of our future trips.
  • Cancellation between 4 to 7 days before the trip - You will not be offered a refund, a full credit of any payments already made will be credited to your client account to be used on any of our future trips.
  • Cancellation between 1 to 3 days before the trip - You will not be offered a refund, 75% of any payments already made will be credited to your client account to be used on any of our future trips.
  • Cancellation on the day of the trip or a no show - No refund or credit will be offered.

Private Charters - Cancellation by you
Should you or any member of your party need to cancel your chosen trip once it has been confirmed, the party leader must immediately advise us in writting by email. Your notice of cancellation will only be effective once it is received and confirmed by us.

As we incur costs from the time we confirm your booking, the following cancellation charges will apply.

  • Cancellation more than 30 Days before the trip - You will be offered either, a full refund for any payments already made less a 5% administration charge to cover bank and/or credit card charges, or a full credit for any payments already made, will be credited to your client account to be used on any of our future trips.
  • Cancellation between 14 to 30 days before the trip - You will be offered, either a 75% refund of any payments already made less a 5% administration charge to cover bank and/or credit card charges, or a full credit for any payments already made, will be credited to your client account to be used on any of our future trips.
  • Cancellation between 7 to 14 days before the trip - You will be offered, either a 50% refund of any payments already made less a 5% administration charge to cover bank and/or credit card charges, or a full credit for any payments already made, will be credited to your client account to be used on any of our future trips.
  • Cancellation less than 7 days before the trip - No refund or credit will be offered.

Cancellation by Us
We reserve the right to cancel or change a trip if;

  • Weather conditions are unsuitable for the chosen trip.
  • Minimum passenger numbers have not been reached.
  • Our boats sustain or have any mechanical, electrical or structural failure.
  • We have encountered logistical or technical issues.
  • We have been confronted with circumstances beyond our control.

We will do our upmost to contact you as soon as practicably possible once a decision has been made. We will endeavour to reach you by any means possibly but primarily using the email and/or mobile provided in your booking details to offer to;

  • Reschedule the same trip for a future date.
  • Choose an alternative trip of the same value.
  • Have your client account credited for a period of 24 months.
  • Exchange for a Gift Voucher valid for 12 months for your personal use or that of a friend.

Gift Vouchers
Gift Vouchers are non-refundable and are valid for 12 months from the date of purchase and we reserve the right to consider any voucher(s) that have been tempered with no longer valid.

In the event that a gift voucher is used towards a trip and if the trip is cancelled or aborted, we will credit your client account to the value of the voucher. For clarity, the credit will be non-refundable and valid for 24 months from the date of cancellation. If the voucher amount did not cover the total cost of the trip and you paid the difference, the difference will be credited to your client account and the credit will be valid for 24 months from the date of cancellation and the difference, and only the difference may be refunded at any point during that 24 month period less a 5% administration charge to cover bank and/or credit card charges.

Declaration of Pre-Existing Conditions
Any pre-existing medical conditions that could affect your voyage must be declared.

Personal belongings
We cannot be held responsible for personal belongings and equipment while on a voyage or charter.

Health Restrictions
We do not recommend our voyages for those with back problems. The decision to travel is the passenger’s own and we accept no liability for any issues arising from pre-existing health conditions. You must declare any condition to the skipper for which you may be refused to go on the voyage and no refund will be offered.

Refusal of Carriage
The Company reserves the right to deny carriage to any passenger whose mental or physical state, or impairment from alcohol or drugs, may present a risk to himself, other passengers or the safe operation of the vessel.
The skipper’s decision is final.
No refund is made in cases of refusal of carriage.

Force Majure
Each party agrees to release the other party from any loss arising directly or indirectly from a failure to perform, or delay in performing, any obligations under this agreement if the failure or delay is beyond that party's reasonable control. Without limiting the effect of this provision, we are not liable to you if our website is down for any reason and you are not able to complete your booking.
